In this policy, "we", "us" and "our" refers to Kaizen Home Loans (Simran Sharma), together with the aggregator and Australian Credit Licensee we operate under, Broker ACL Pty Ltd, as set out in the Credit Guide provided to you.
Our commitment to your privacy
Protecting your personal information matters to us. This policy explains how we handle personal information we collect about you, and what it's used for. We only use it for the purpose it was collected, or as the law allows, and we handle it in line with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
What counts as personal information
Personal information is anything that reasonably identifies you — including your name, contact details, and information or an opinion about you. It can also include credit information: details used to assess your eligibility for finance, such as any existing loans, your repayment history, and any defaults, which is typically exchanged between credit and finance providers and credit reporting bodies.
What we collect
This can include your name, date of birth, address, contact details, account details, occupation, and anything else needed to confirm your identity. If you get in touch through this website, we may also note the type and amount of finance you're interested in, along with anything else you share with us directly or through your use of the site. If you go on to apply for finance, we may also ask about dependents or others living with you, how long you've been at your current address, your employment, income and expenses. Health information is only ever collected with your specific consent — for example, if you're applying for an insurance product through us.
Why we collect it
We collect personal information to assess and manage your finance application, and to maintain our relationship with you — including letting you know about other products or services that may be relevant from time to time. On this website specifically, we collect it to respond to enquiries and send you information you've asked for.
How we collect it
Wherever practical, we collect information directly from you. We may also receive it from LM Broker Services, other finance brokers, or professionals you're working with, such as your accountant or solicitor.
Who we may share it with
- Lenders and other parties involved in arranging your finance
- Organisations that help administer your finance, such as mailing, printing or call-centre providers
- Businesses associated with us that may want to market related products to you
- Our technology and infrastructure providers
- Anyone acting on your behalf, such as your broker, solicitor or accountant
- Anyone you've told us we can share it with
- Where the law requires it — for example, under anti-money laundering and counter-terrorism financing legislation
- Investors, agents or other parties with an interest in our business
- Your employer, referees, or identity-verification services
Before we disclose your information to anyone else, we take reasonable steps to make sure they protect it as carefully as we do, or that you've consented to the disclosure.
Overseas disclosure
We may disclose your information to related businesses and service providers located overseas — including data hosting and IT providers based in a number of countries, which may include the Philippines, India, Canada and the USA. Where information is stored in the cloud, it may be held in other countries too. Information handled overseas is subject to that country's laws, which may not offer the same protections as Australian privacy law. By providing your information, you consent to it being handled this way.
Direct marketing
We may occasionally use your information to tell you about finance-related offers, news, or new products — from us or related organisations. You can opt out at any time by contacting us, or via the unsubscribe link on any marketing email. There's no charge for this, and we'll action your request as soon as we can.
Keeping your information current
We rely on you to let us know if your details change, so that what we hold stays accurate and up to date. You're welcome to update your information with us at any time.
Accessing or correcting your information
You can ask to see the personal information we hold about you at any time (we may charge a reasonable fee to cover the cost of retrieving it). We'll generally respond within seven days, though some requests take longer if we need to check with other parties — for example, if the information relates to an existing legal matter, or the request is vexatious, we may not be able to provide access, and we'll explain why. If anything we hold about you is incorrect or out of date, let us know and we'll correct it where appropriate — usually with an initial response within seven days, and confirmation of any correction within 30.
Government identifiers
If we ever collect something like your tax file number, it's only used or disclosed as the law requires — never as a general way of identifying you.
If you'd rather not identify yourself
Where it's practical and lawful, you're welcome to deal with us without providing personal information — for general questions about rates or current offers, for instance. For most other things, we'll need to know who you are to help you properly.
Sensitive information
We only collect sensitive information — such as health information, racial or ethnic background, or union or association memberships — with your consent.
Keeping your information secure
We store personal information securely, in both paper and electronic form, and take reasonable steps to protect it from misuse, loss, or unauthorised access, modification or disclosure.
Complaints about your privacy
If you're unhappy with how we've handled your personal information, or you have a complaint about our compliance with the Privacy Act, please get in touch directly — see our Feedback & Complaints page for how. We'll acknowledge your complaint within seven days and aim to give you a decision within 30. If you're not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
